Understanding Restraining Orders in New Jersey
Domestic violence in New Jersey includes both civil restraining orders (TRO and FRO) and potential criminal charges. Here's how they work:
Temporary Restraining Order (TRO) — Issued quickly, sometimes without the accused present. Can remove you from your home, limit contact, and lead to weapons seizure. You must appear in the Superior Court, Family Part for a final hearing.
To obtain a Final Restraining Order (FRO), a plaintiff must prove by a preponderance of the evidence that:
- A predicate act of domestic violence occurred (assault, harassment, stalking, etc.); AND
- There is a compelling need for the entry of the FRO (protection from future harm).
Criminal Charges Can Follow — If the conduct also violates New Jersey's criminal code (e.g., strangulation, aggravated assault), you may face indictable crimes with enhanced penalties due to the domestic violence component. For example, strangulation can be charged as a second degree crime.

Weapons Seizure Upon TRO Entry
Upon entry of a TRO, law enforcement in New Jersey will seize all weapons from the defendant, including any Firearms Purchaser Identification Cards or carry permits.
If criminal charges are also filed, the County Prosecutor may file a Temporary Extreme Risk Protective Order (TERPO) seeking continued seizure of weapons. The prosecutor must prove by a preponderance of the evidence that the defendant poses a significant danger of bodily injury to themselves or others by possessing firearms.
